Question: What do I do if I think my personal information is incorrect?

Answer: You must write to the Council stating what data is incorrect and asking for the data to be corrected. If the Council does not agree that the information is incorrect i.e. the information is a professional opinion, rather than a matter of fact, then your comments can be noted on your records, together with the original details.

You can also appeal to the Information Commissioner (who oversees compliance and promotes good practise) or the Courts if the Council does not correct the information. - Related Link

Question: How do I obtain a copy of my personal information?

Answer: You must write to the Corporate Information Unit by email at information@iow.gov.uk, or by post to Legal Services, County Hall, High Street, Newport, IW PO30 1UD. There is also a form available on our website to assist individuals to submit a request. You will need to provide your name and address together with the names of the departments whose information you wish to access and any other details that will assist with identifying relevant information, such as your date of birth, previous addresses, reference numbers etc. You will also need to provide identification to prove your identity.

Question: Do I have to pay to see my personal information?

Answer: Access requests are generally free of charge. There is no standard fee for accessing personal data. However the General Data Protection Regulation (GDPR) does allow organisations to charge a fee for requests that are manifestly unfounded or excessive or further copies of data are requested following a request. You will be notified if a fee is applicable.

Question: How can I ask for my details to be erased (right to be forgotten) from council records?

Answer: The General Data Protection Regulation (GDPR) provides a right for individuals to have their personal data erased. This right is also known as ‘the right to be forgotten’.

Requests should be made by writing to the Corporate Information Unit by email to information@iow.gov.uk, or by post to Legal Services, County Hall, High Street, Newport, IW PO30 1UD. The council will respond to any requests within 1 month, or for complex requests this timeframe may be extended by up to 2 months.

The right is not absolute and only applies in certain circumstances.

Individuals have the right to have their personal data erased if:
• the personal data is no longer necessary for the purpose which you originally collected or processed it for;
• you are relying on consent as your lawful basis for holding the data, and the individual withdraws their consent;
• you are relying on legitimate interests as your basis for processing, the individual objects to the processing of their data, and there is no overriding legitimate interest to continue this processing;
• you are processing the personal data for direct marketing purposes and the individual objects to that processing;
• you have processed the personal data unlawfully (ie in breach of the lawfulness requirement of the 1st principle);
• you have to do it to comply with a legal obligation; or
• you have processed the personal data to offer information society services to a child.
