Condition Discharge

Explanation of Planning Conditions

Conditions are often applied to approved planning applications. The full list and details of the planning conditions are defined on the Decision Notice, along with the justification for the condition. It is a requirement of the planning permission that all of the conditions are implemented in accordance with the Notice.

Discharging the conditions

It is the applicants, or their agents’ responsibility to ensure that the conditions are followed and discharged. The Council has an application form that must be used to apply to discharge the conditions. If you are making an application to discharge conditions, please be sure to complete the form and to identify the correct planning application number and condition(s), along with any supporting information considered appropriate.

The Local Planning Authority will acknowledge the receipt of your application in writing within 5 working days, and will look to deal with all requests to discharge conditions within 8 weeks. For more complex condition discharge requests, the Local Planning Authority would anticipate dealing with the request within 12 weeks.  For the majority of these applications it will take less time than this, and the nominated planning officer will keep you informed on progress by your preferred method of contact.

With effect from 1 April 2015, the Council will implement the national fee charging regime to accompany condition discharge requests.  (The Town and Country Planning (Fee’s for Applications, Deemed Applications, Requests and Site Visits) (England) Regulations 2012.

Each request may relate to any number of conditions. Otherwise, each individual request will require the fee as set by the Regulations.

Listed Building Consents and Conservation Area Consents do not form part of this process and no fees will be charged for the discharge of conditions on these types of applications.

Please note: The form can be submitted on-line via the Planning Portal (but you will be required to log-in in order to use this form), or you can hand the form into the Planning Office at Reception, or Post your completed application to the address found in the 'Contact Information' tab.
