Question: I am concerned about a development not being carried out in accordance with the approved plans. Who should I report this to?

Answer: Please complete the Planning Enforcement Complaint Record Sheet online or print it off and return to Planning Enforcement, Seaclose Offices, Fairlee Road, Newport, Isle of Wight, PO30 2QS.

Question: What is enforcement?

Answer: The planning enforcement team deal with suspected breaches of planning law by individuals and commercial businesses.

Any building work that normally requires planning permission from the council but is carried out without first obtaining such permission, constitutes unauthorised development. This is one of the most common causes of complaint that we receive from members of the public.

Carrying out unauthorised development is not a criminal offence and therefore cannot be treated as one, unless the property is a listed building. When this is identified we can request that the owner of an unauthorised development submits a retrospective application to regularise the work (obtain consent).

Please note that not all building work requires planning permission. Permitted Development allowances do allow some specified building works and changes of use to proceed without the need to submit an application for planning permission so check the Planning Portal website for advice. - Related Link

Question: I recently made a complaint about a breach of Planning legislation. Can you tell me how the investigation is progressing?

Answer: Each complaint is acknowledged either by letter or email. However, if you wish to discuss the developments of the investigation as a result of your complaint, you are advised to telephone 01983 823552 and ask to speak to the investigating officer detailed at the top of the letter or email the Enforcement Team at enforcement.team@iow.gov.uk quoting the reference number. - Related Link

Question: I am aware of work being carried out that does not have planning permission. Who should I report this to?

Answer: Planning permission may not necessarily have been required. Any enforcement allegation needs to be made in writing. The related link will take you to the Planning Enforcement Complaint Record sheet and should be completed online by the person wishing to inform the authority of the potential breach. Alternatively, you can report it in writing to Planning Services whose contact details can be found at the 'Contact' tab at the top of the page or by emailing enforcement.team@iow.gov.uk
